1. Introduction

Welcome to cnify ("Service"), operated by Dmytro Shatrov, an individual entrepreneur registered in Ukraine ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our Service, accessible at cnify.app. By using our Service, you agree to these Terms. If you do not agree, please do not use our Service.

2. Service Description

cnify is an AI-powered service that generates shadcn/ui themes inspired by arbitrary uploaded image. The Service provides AI-generated shadcn/ui themes in a form of command that must be executed on user's terminal. Users can access the service by purchasing virtual tokens.

3. Eligibility

You must be at least 18 years old or meet the legal age of majority in your jurisdiction to use our Service.

4. User Responsibilities

By using cnify, you agree:

  • To provide accurate and up-to-date information when signing up.
  • Not to use the Service for illegal, harmful, or unauthorized purposes.
  • To comply with the licensing terms of any third-party libraries or code included in AI-generated snippets.
  • That you are solely responsible for reviewing and verifying the AI-generated code before using it in any projects.

5. Tokens & Payments

cnify operates on a pay-as-you-need basis using virtual tokens:

  • Users receive one (1) free theme generation upon registration
  • Additional theme generations require tokens (100 tokens per generation)
  • Tokens can be purchased in bundles through Dodo Payments, our Merchant of Record
  • Tokens never expire and can be used at any time
  • Tokens are non-transferable and non-refundable
  • Users can check their token balance in their account dashboard

6. Withdrawal Right & No Refund Policy

If you are a consumer based in the European Economic Area (EEA), UK, or other applicable regions, you may have the legal right to withdraw from your token purchase within 14 days of purchase, provided the tokens have not been used. To exercise this right, contact us at support@cnify.app before the withdrawal period expires.

No Refunds for Used Tokens: Once tokens have been used for theme generation, they cannot be refunded. Unused tokens are eligible for refund only within the withdrawal period where applicable by law.

If your subscription has already started when you notify us of your withdrawal, we may deduct an amount proportional to the service used before issuing a refund.

No Refunds: Except for the withdrawal right (if applicable), we do not offer refunds for dissatisfaction with the Service.

7. Intellectual Property

  • cnify does not claim any intellectual property rights over the content users create using the Service.
  • We do not claim ownership of code snippets generated by the AI. However, generated code may be derived from publicly available sources or models trained on open data, so it is the user's responsibility to verify any licensing obligations before commercial use.
  • You grant us a limited license to use your input data for improving AI suggestions (where applicable and with appropriate anonymization).
  • By using our Service, you grant us the right to use your generated themes and uploaded images for marketing, promotional, and advertising purposes. This includes but is not limited to showcasing themes in our portfolio, social media, website, and other marketing materials. We will exercise this right while respecting user privacy and without disclosing personal information.

8. Liability Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind.

  • We do not guarantee that generated code is error-free, secure, or fit for any specific purpose.
  • We are not responsible for any damages, data loss, security vulnerabilities, or legal issues resulting from the use of AI-generated code.
  • You acknowledge that AI-generated code may require manual review and modification before use.

9. Privacy & Data Handling

We store user-generated themes in our secure databases and user-uploaded images through UploadThing, a third-party provider. Authentication and user data management are handled by Clerk, while payments are processed through Dodo Payments. These third-party services process and store data in accordance with their respective privacy policies. By using cnify, you acknowledge and agree to their data handling practices.

We use Vercel Analytics to collect anonymous usage data to improve our service. This analytics data does not contain personally identifiable information.

Your uploaded images will be stored on UploadThing's servers, and you grant us the right to store and process these images for the purpose of theme generation. While we maintain secure storage of your generated themes, you retain all rights to the themes you create using our service.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of Ukraine. Any disputes arising from these Terms will be resolved in the courts of Ukraine.

11. Changes to Terms

We may update these Terms from time to time. Users will be notified of significant changes. Continued use of the Service after changes means acceptance of the new Terms.
